Need help on abortion, marriage in Texas regarding parental consent.


Hi, I live in Texas and am not sure the laws concerning abortion and marriage. I am 18 and my girlfriend is 17. There is a chance that she may be pregnant so I am researching the laws about it. First of all, is there any way that a seventeen year old can get an abortion without a legal guardian? If so, then how? If not, then can I be considered a legal guardian if we get married? And do we have to have her parents permission to get married? The whole thing is that we simply cannot tell her parents that she is pregnant or that she is planning on getting an abortion. She will not be 18 until October and that is eight more months so she would be almost due if in fact she is pregnant. Any help would be greatly appreciated. Thanks!

Well, bad news for the two of you, dude. According to Jane's [url]http://www.janesdueprocess.org/thelaw.htm[/url] the doctor has to give her parents/court-appointed managing conservator/legal guardian at least 48 hours notice OR your g/f has to obtain a court order to waive the notification pursuant to Texas Family Code § 33.003 or § 33.004.

To get married, y'all would need either her parent's consent or a judge's order.

Does that mean that we do not really need parental consent, but only need to let them know that we are doing it? And what could they do to stop it? That may be our best option if that is the case.

Or you could have the kid and put it up for adaption. The only reason I'm saying that is, years later your girlfriend could have some emotionial problem where she may end up regreting aborting the baby.
My advice tell your parents what is going on, let them help you all come to a descion you all will be able to live with. Parents love their kids, not matter what. Don't be afraid that's wht their there for.

Someone very close to me went through a simliar situation, and i ended very badly, between everyone. I would hate for that to happen to anyone else.

Well, I am just trying to find out our legal options. I want to know if there is a way to do this without parents knowing. I do not want her to go through high school pregnant. This would change everything for us if she would go through with this and it would not be for the better. I still do not know for sure if she is pregnant and am hoping she is not, she is taking the pregnancy test tonight. After that she's getting on birth control for sure.

The only way for her parents not to know is for her to take it in front of a judge. Frankly, if the two of you thought you were mature enough to have sex, you should be mature enough to face the music of telling her parents. Playing grown-up isn't always fun.

Stealth, you seem to be very helpful. Do you (or anyone else reading this) happen to know how to go about filing something with the court and what to file regarding this. Do I just call my local sheriff's office or what? Internet is great for info but I can't find anything on this. Maybe I should go to the my college and ask a law professor.
About having sex, I do not think that it was conceived by having sex, I think it was just by fooling around. That is what is so irritating about it.

I got pregnant from swimming in a public pool.

I still haven't told my parents and my daughter is 16.

Do you think they have noticed....?

Exactly what kind of fooling around do you do? You can't get pregnant just from kissing.

I know you guys don't want to tell you parents, but its the right and most mature thing to do. I'm only saying this because, what if something goes wrong. Do you know that some girls have gotten infections from having an abortion? I would hate for your girlfriend to get sick.

But I really think your parents and her desereve to know whats going on. If it were my kid, I'd like to know and be able to help out. Your parents raised you, brought life to you, they love you no matter what. You don't have to go through this alone.

Because could you really keep a secret this big for the rest of your life?

That is the single funniest thing I have ever seen or heard about in my several decades on this planet. I can't stop laughing.

What in the heck do you think "sex" is?

If she is pregnant, but you did not have full sex with her, then......hate to tell you, but she got busy doing the full with someone else.

Actually, a female can become pregnant without having intercourse by what in my day was called "heavy petting". It's rare but it can happen. That's probably what stealth was referring to when she mentioned "health class." But then again you could be correct and was getting busy with someone else.

Guys, I know all the ways it could have happened and it really doesn't matter how it did. She took the EPT yesterday and it turned out negative but still hasn't had her period and it is late by now. Anyways, I thought this site was just for legal advice. This is my first post so I guess I could be wrong, anyways thanks stealth for your advice.

Well then maybe she should go to the doctor, to get it checked out, she might not be pregnant, but something else could be wrong.
It's better to be safe then sorry.
