Need Help on SOL??? IN washington state


I am in washington state. I have a debt that was turned into a lien on my property. I filed Bankruptcy in 2000. But the debt was incurred in 1987. It was put on my property by an attorney of my ex-wife. I have tried several times calling and asking the attorney to remove it. His para-legal always tells me hes busy and he will return the call. I have not recieved a call. I think the attorney is dissing me. How can I get the lien removed if he wont call me so I can let him know he needs to under SOL to remove it. Also my Bankruptcy attorney stated He needs to remove it. I need someones help. I dont want to make this attorney mad at me and sue me if I send a letter asking him to remove it by State Statue of Limitations. Please help me. I cannot get my home refinanced with a lower interest rate unless he removes his lien.

What type of debt was this; e.g., taxes, child support, alimony, student loan, etc.?

Also, if it was a judgment lien (as I suspect), what was the date the judgment was rendered??

Was this a debt that was discharged in the bancrupcy?


If this is not CS and IS included in the list of creditors in the bancrupcy, the title insurance company that is writing the "mortgagee's policy" for the refinance may be willing to review your bancrupcy papers, esp. the list of creditors, and see if they may be in a position to offer "affirmative coverage" over that item in their policy. If so, the refinance can go forward without the release IF the title company has a comfort level about this item and whether the bancrupcy can be considered to have taken care of this debt.
