Unhappy

Need some advice please !!!!

What is the name of your state? Hi I watch Court TV all the time and I think it’s a great show but now I have a question that I need help with.
My family has been involved with the Department of children and family’s for about one year,
Yesterday we went to court and the family court judge was not there so they had a criminal judge hear the case. We went in to court and the Judge said that he did not know any thing about family court proceedings because he was a criminal judge and not a family judge, he stated that he did not have the qualifications for this matter and did not know what to do, he asked the attorneys witch included mine my wife’s and the children’s if they had any suggestions and the children’s attorney said that she wanted to put a bench OTC out, the judge throw up is hands and said I don’t know what that means, but if that’s what you want then so ordered, little did he know that he just gave the DCF people Custody of my children.
The only thing I did was remove my children from a bad environment into a very nice community (Greenwich CT).
My question is can a Criminal Judge make a ruling in a family court without having any knowledge of the case or the situation?

Please help I need my children back

Thanks

What did your lawyer say to the judge? What is your lawyer saying about an appeal? Sounds like you might have one who has no clue when it comes to fighting social service. Therefore you are going to have do most of the research yourself. You need to fight (and it will get ugly!) for your rights & that of your children. To get started, you first need to learn what those rights are. Go here, upper right corner, *parents guide to the system*: http://www.cpswatch.com/oldsite/

well my state appointed lawyer just sat there and she said that she is going to file a motion to dismis this order.
in the mean time i dont have my children and its killing me i cant eat or sleep i dont have lots of money so i cant get a good lawyer.I bet if i had a privet lawyer this would never have happend to me becuase i belive that what should have been done was to order a new court date till the regular family court judge returnd from where ever.

That's why you have to start doing your own research & manage the attorney you do have. Start digging!!!!
I bet we are dealing with little kids here too...under say the age of 7?
You need to hurry this along. Under federal law if your children are in foster care 15 out of 22 months your rights will terminated & they will be adopted out.
