new wife filing jointly


What is the name of your state? california

can i be liable for my husband's child support (including arrears) if we file jointly? can my wages be garnished?

My response:

Child support and arrearages are not determined by tax filing status. Only a court order can make you, the new spouse, liable in whole or in part for your husband's responsibilities - - and then only under rare and extreme circumstances.

However, if you and your husband have filed a joint income tax form, and if there is an "interception" order received by the bio-mother, then any tax refund will be intercepted and sent to the bio-mom. Presumably, some of that refund is yours due to your income. So, in that instance, and since your share of the refund will also be taken, then your husband is also making you responsible.

You can avoid this by filing separately from your husband.

Dear i am liable,
Thank you so much. I understand what could happen to my tax returns. I just don't want my wages attached also since by filing jointly there is link with our ss#. But now I understand.
