Obstruction of CustodyWhat is the name of your state? Georgia Any body know anything about " Obstruction of Custody"? Dose this law apply only to devorced parents or can it apply to thy neighbor? |

| My daughter ran away to the home of a 12yr. friend of mine . (ex friend) when we found her i asked him why he did not call me.he awnsered ,"she told me that you knew where she was. then five minutes later i asked him if she had money and he awnsered "she has money becauce she offered me money for rent". after realizing he was lieing to me i said " if you are any friend to me you will put her out of your home" . he did not . the next day i met with him to explain the advice from a counselor we had talked to. at the begining of our meeting i asked him not to tell her about the meeting for fear it would make her run agian. i also said that if he could not promise not to tell her then our meeting was over. he made the promise . that same day she was in our drive way cousing me for meeting with him behind her back.some of the things i told him in the meeting were: do not include her in family outings ; do not loan her a car ; do not take her any where , she has a car at home. the next day i saw her at the store in his car. the following day her brother and i went to the high school for open house. i bumped into her in the hall and saw a brace on her arm. i asked how this happened . she replied that she had a wreck on his personal water craft while out on the lake with their whole family. I called his home phone that night hoping to talk to her . i wanted to make sure that she had every thing she needed for the first day of school the next day. his youngest son awnsered and said that his dad and my daughter were out "collecting money". this was 10 pm the night before the first day of school. I then decided to watch to see when they got home . I drove to the empty lot accross the street hidden from veiw and witnessed them returning to the house at 4 o am. Come to find out later they had gone to atlanta to the "party district" to go to a bar. they could not get in because she is under aged.The next day the bar owner from down the street came to us and said that they came to his bar a few days earlier and she was drunk and they were buying her drinks . his bouncer had to throw them out.At this point we called juvenile court and had her arrested as a run away.Last edited by zinger54; 02-10-2004 at 10:27 AM. |

| And why have you not yet filed charges of harboring a runaway against the so-called friend? You need to go back to the police and file against this idiot. |

| Hello? You're her parent. What are you doing sneaking around, meeting with the "friend" who's housing her, following her around, etc. Why haven't you called the cops and reported her as a runaway? Why haven't you just gone over there and dragged her home? Why are you letting all this time go by? Do you see any problem with how YOU are handling this situation? |

| This is what I am trying to find out. If indeed I do have a case agianst this idiot. It seems as if he was lieing to me to prevent her from comeing home. Do I have a case ? How do I go about filing charges? |

| It may well depend - on how long she was there and what you did to bring her home. If you knew she was there since October (just going by your first post), were meeting with him to discuss her, etc - you may not have a leg to stand on if you weren't trying to get her to leave. |

| Yes stealth , I do see a problem but I didn't know what to do. I wanted to have proof .I also wanted her to learn a lesson and want to come home on her own. |

| You can't have it both ways, though. You wanted her to learn a lesson and come home on her own (?) but you want to hold him responsible for her not doing so. You're her parent. If this had been my child, she'd have had about 2 days to come to her senses. If she hadn't - I would have called the cops and asked that they charge this guy for harboring a runaway and contributing to the deliquency of a minor. THREE MONTHS? While you're telling him what he can and can't do wrt her upbringing? Do you see how screwy a parenting decision this is? |

| Yes I was definatly trying to get her home . but it was a touchy situation . she was rebelling her parental athority . so any knowlage to her that we were trying to get her to come home was pushing her away. She did come home . And because she was very angry and threatened to run agian (to mexico) we permitted her to stay at grandmas house for a while to think and to let things cool off. durring this time she was attending school and going to counseling once a week. one sunday (family day) we picked her up and went on our usual family outing. she was a total ass the whole time and was mean and rude to the whole family. we returned to grandma's house to drop her off . She, as usual, started being very nice as if she she did not want us to leave. (she had acted this way before at the end of a family get together) My wife and I (being fed up) both turned to the backseat of the car and in simutainosly said " get out of the car!". This caugth her by suprise and made her angry. She yelled some profanity as we drove off. That evening grandma called and said that she(daughter) was very angry and had never seen her this angry before.The following monday was her next appiont ment with the counselor . Well......she went and told the counselor that I had molested her and her brother was scared of me and that we were drug addicts ,drug manufacturers and drug dealers. Now see what I am up agianst? As time past with DFCS on our ass and neighbors pointing fingers ,Police visits . **************And so on .....She did return home on her own and has admitted to lieing and was sorry for everything she had caused. But DFCS is still haunting us. Now can you see what i was up agianst? |

| I am asking him to do whats right !!!!! and he was doing the oppisite. Is this a legal advice forum or a parenting forum? Yes we do screw up as parents as i'm sure you did from time to time . This is our first time being parents and I dont know about you but I didn't recieve a manual at the hospital . I am simply asking for legal advice. |

| You have no case against the man since he was acting as your agent in this matter. Forget it and move on. You have bigger issues. |

| We did do everything we could think of to get her home . He was doing everything he could do to keep her there. She was there 4 days before we had her arrested. She spent the night in RYDC. HIS quote to friends and neighbors," hey look I traded my wife in on a 17 year old". As my head nearly exploded!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! |

| Honestly? You haven't said anything about how you tried to get her home. So far she's lived with the "friend", grandma, and .... where else? |
