one sided divorce


What is the name of your state? Chewy from Ma.
I want to divoece my wife of 20yrs. Because I'm in love with another women.My wife knows about her.I live with her but my wife says she will never divorce me.Can I divorce her without her signing the decree?On what grounds would I use sibce I'm the one with the girlfriend?

My response:

Chewy, MA is a combination fault and no fault divorce State. She doesn't need to sign anything for you to obtain a divorce. Your wife is living under a belief that hasn't existed for years; i.e., that she has a choice to "agree" or "disagree" with the divorce. I would definitely consult with a local attorney, Chewy - - especially with regard to your property issues.

Grounds for Divorce in Massachusetts

NO FAULT GROUND:
- irretrievable breakdown of marriage relationship

FAULT GROUNDS:
- adultery
- impotency
- desertion for one year
- habitual intoxication
- cruelty
- sentence to confinement for life or for five years or more
Family Code: c. 208, 1, 2
