Parental financial responsibility


What is the name of your state? California
My 21 year old son is heading for trouble. Although we have begged him to change his ways, its only a matter of time before he winds up in jail. He moved out two months ago to live with a friend. He hasn't changed his address with the department of motor vehicles or anyone else. His car is insured on our policy, although he is the legal owner. His medical and dental insurance is covered by my family plan through my employer. We claimed him as a dependent on our 2002 income taxes. What is my liability if he gets in trouble or in a car accident? I want to reduce my liability to zero. How can I do this?

You say to him, "son, you are a man now - choosing to make adult decisions so you are going to have to take adult responsibilities" then you remove him from your insurance and step back and let him do things on his own.

My response:

You haven't been legally liable or responsible for him since he was 18 years old. The age of adulthood changed in 1974, from 21 to 18 years of age. And, since he's been 18, it didn't matter where he lived - - with you in your house, or someplace else - - you haven't been responsible for him!

I can hear it now, "Do you mean to say that I've been wasting thousands and thousands and thousands of dollars on this kid for nothing?" Yep, that's right! Had you known the law, all of that extra money you've been spending on him could have gone into a retirement account.

Stop cursing.
