You never ignore a court order, legal papers, Subpeona etc. If he has been issued a Subpeona, then he needs to go.
I am surprised that as a parent, you think it is ok for one child to threaten another and get away with it. I hope you would at least think differently if someone threatened your own child. 'Simple' threats like this have resulted in the deaths of many children over the last 5 years.
