Question

Parential rights

What is the name of your state? ND

Ok, i have a couple questions. I have a 3 year old son with a woman. We were never married. She came and told me she was pregnant, and that was it. The next thing i get is a court ordered document saying that i will be paying child support. I have been paying it the whole time. We did not have a blood test done or anything. I am not able to contact her, i have no idea where they live, if there ok, anything. I have tried talking to the regional child support agency, and they say the cannot tell me anything. What should i do? Do I have the right to know anything?

Get blood test to make sure on paternity issue once and go talk with a family law attorney to file suit for visitation joint custody should the child prove to be yours .

After 3 years of paying support (and not contesting paternity at the time you were ordered to start paying) you will likely be considered the legal father, whether you're the bioDad or not. Likely the best you can do at this point is file for visitation (why did you not do this in the first place) and try to be a Dad to this child.

You need to see a lawyer (for a free/low cost consult) and/or check your state laws to see if you can request a DNA test after all these years. Each state is different and I don't pretend to know what your state guidelines say. Other then that, you need to file for custody/visitation...child support is a seperate issue. In order to have your rights enforced, you'll need to file for them. In general, it's not that hard to do it yourself! *S*
