paternity and usmc father


What is the name of your state? ga
I have a 5month old son whose father was active duty in the usmc and died suddenly. I have dna results to prove that he is the father. I'm having trouble getting the military benefits for my son. I have sent them a copy of the test results but they want a judge to legal declare my son as his father dependent. I filed a petition in juvenile court but was told that juvenile court could not do it.I have contacted my congressmen,JAG,and legal aid but I,m not getting anywhere.I would also like for my son to have his father last name added to the birth certificate as well as my son taken his father surname.I was told that my son is an illegimate child and would be lucky if he got any thing.I always thought that military always takes care of their own but i don't know if I believe that anymore and I don't think my son has to be punished for his father passing too soon. I should add that he had an ex wife and a son from the marriage and she doesn't have any problems getting anything she needs.If anyone has any valuable info.please email me @ [email]brendacannady@hotmail.com[/email]

Hello! I am sorry to hear about your problems with getting military benefits for you child. You are in for a battle since the father passed away. I got pregnant with my daughter before me and my hubby married, and when the military realized that I had an @$$ load of paperwork to fill out, among them was paperwork from JAG stating she was his child, and they did a DNA test on her and my hubby to back it up. So yes they do look out for their own. I do hope you get this worked out.

I e-mailed you privately but I wanted to add to what I had sent you.
Regarding "Military" benefits there really are none due your child as the father has passed on......the "military" benefits are health coverage and other items regarding pay while the active duty member is alive..... IF the death was in the line of duty there are certain special pay outs that can be available BUT if not then the only "benefit" from the military itself would be the payout of his SGLI (life insurance) which would have already been paid out to the beneficiary he named.
However your child IS entitled to Social Secuity benefits - but it will be a battle there too as you will likely run into the same issue of them wanting a COURT issued document proving that he is the father which you can use to have him listed on the baby's bc......I would suggest you contact the SS office and inquire with them what specifically you need to be able to file for your child's benefits if you have DNA proof of peternity.
