Phone conversation recording of children with other parent....


What is the name of your state? CA

OK, I know the other party has to be notified and agree to being recorded when talking on the phone, I have learned that children can not be recorded - but - if a parent pays the phone bill for that child and that child is talking with the other parent - who gives consent to being recorded, is it still legal to record the child?

Do you mean the parent who is on the other end speaking give consent to the parent where the children are speaking from gives consent? That's probably okay if you're in a one-party state. But think what it does to the kid to know they can't say anything to the other parent that you won't know about.

what if


So is it illegal to record phone conversations between child (5yrs) and mom while she is at dads house? The reason we have been recording is mom is playing parent alienation (sp?). So we are trying to add into our court order a limit on phone calls. They are disgusting I promise.

The child's other parent has the right to an expectation of being able to speak with his/her child privately. As far as I know, you cannot tape the other parent during a phone call when the child is in your home. I would suggest you run this by your lawyer, 'cause I think you're on very shakey legal ground.

CA is a two party state. Both parties need to be made aware that the call is being recorded.

has a listing of one-party and two-party states. If either parties are in a two-party state, both parties must be aware that the call is being recorded.
