Please Advise Quickly


What is the name of your state? MS

I am 26 and my girlfriend is 18. I know thats a big age difference but please bear with me. We want to go to another to state to be married but want to know when we do if her mother can go back to when my girlfriend was a minor and press charges on me for statutory rape as a revenge tactic. I was with her when she was a minor also with parental consent but then was told not to see her anymore. Please advise.

You can always call the magistrate and ask them what the statute of limitations is on that.

Also you can ask them what the Age of Consent is there. For example in some states it's 16. So if you were with her at the age of 16 or after then I don't believe her mother can have you charged with staturtory rape.

My response:

You don't need to "go to another State" to be married.

Your girlfriend is an adult, and has been so ever since she turned 18 years of age. She is now legally entitled to enter into a lawful marriage contract, and fill out, and sign, the marriage license application.

So, go get married at City Hall if you want to.

We will have to go to another state because as far as I have seen the legal marriage age in Mississippi without parental consent is 21. Alabama and Tennessee both are 18 though.

My response:

"Mississippi - -
Under 21: Parental consent is needed if under 21 years of age. If parents or guardians do not give consent at time of application, they will be notified via certified mail. The marriage application will be held for three (3) days. Marriage licenses cannot be issued to males under 17, or females under 15 years of age. If the clerk receives a signed authorization from the parents, this minimum age requirement can be waived."


Well, blow me down with a feather!

How stupid is that? You can vote, you can fight for your country and die, but you can't get married. Ridiculous.

So, get married in another State. Mother can't do anything to have you prosecuted because the "star witness", your wife, can't be forced to testify against you.
