please help


my mother is about to die. her and her boyfriend have raised my little sister for 7 of her 9 years. my sister's birth father lives in kokomo, IN. at present time they have joint custudy, however I need to know what needs to be done legally for my mothers wishes and sisters for that matter. they both wish for her to stay with my mothers boyfriend? what is my first step? my sisters father lives in anoter state, would we have to go there to have this pocess done?

I am sorry that your mother is going to pass away. However, your sister's father will be first in line for custody, particularly since they have joint custody, and there is virtually nothing that you or anyone else can do to stop him from having custody of your sister, if that is what he wants.

Even if your sister's father was unfit, your mother's boyfriend would have absolutely no standing whatsoever, to even file for custody.

Everyone is going to have to accept that. In fact, if you try to do anything else, its possible that her father could even cut all of you off from even seeing your sister. Its critical that you keep a decent relationship with your sister's father.
