i live in california and my mother is in a nursing home in pennsylvania. I am the poa and representative payee for her.there was fraudulent use of her master card and her atm card. the first union bank replaced the funds stolen from the atm but not the $9000.00 placed on the master card. i dealt with first union's fraud department, by mail and phone and since my mother has no assets i thought the matter was closed. first union sold the account to a collection agency and they are going for a judgement against my mother. my question is am i liable for any of my mother's debts even though i am just the poa? can they attach the representative payee account against the social securities rules? can they attach a burial account that is in an irevokable account payable to the funeral home? also do they have the right to harrass me for this debt?
