| pre-nup needed? What is the name of your state? California
I am getting married and each of us currently own our own houses. I have retirement $$ and some other savings also. She pretty much only has her house. We will be buying another house and selling ours once we get married. Since we live in a community property state, I'm questioning whether or not we even need a pre-nup, since all assets held before marriage are considered personal property. All I was concerned about was being able to retain my previous assets in the case of a divorce. I'm fine with the splitting of everything else acquired during the marriage. As far as I can tell, California law already does everything that I would want written into a pre-nup. Am I missing anything? (Obviously, in case of divorce, one of us would have to buy the other one out of the house, or jointly sell it, with all equity that was built during thr marriage being split) |
