Premarital assets


What is the name of your state? CA

I am about to get married. I own 2 homes: home #1, I paid for outright (solely under my name) and home #2, I own with my mother (with her name and my name on the title). Home #1 is an out-of-state rental property and home #2, my mother and I currently live in. However, home #2, there is still a mortgage and the loan is just in my name, although my mother and I pay equally.

When I get married, my husband and I will be getting a place of our own. My mom will continue to live in the house and perhaps we will rent out part of it to make-up my loss of the mortgage payment. My income will not go towards the existence of this home.

In community property states, how do I protect my and my mother's real estate property, if my marriage ends? Will a pre-nup be sufficient? How long will the pre-nup hold up?

If I decide to sell home #1, and invest in something else. How can I protect that investment or the money I get from home sale?
