Quad Order Not Filed By Ex Wifes Atty


What is the name of your state?FLORIDA
IT HAS BEEN THREE YEARS SINCE MY DIVORCE. i HAVE A RETIREMENT PLAN AT WORK. A PERCENTAGE OF MY SALARY IS PUT INTO THE PLAN BY MY EMPLOYER. i AM FULLY VESTED AND WAS VESTED AT THE TIME OF MY DIVORCE. AT THE TIME OF MY DIVORCE MY WIFE WAS TO BE ENTITLED TO 50 PERCENT OF WHAT WAS IN MY RETIREMENT ACCOUNT. THIS WAS TO BE DONE BY HER LAWYER FILIEING A QUAD ORDER. HE HAS NEVER DONE SO. IF THIS IS NOT DONE UNTILL I RETIRE I AM CONCERNED THAT IT WILL BE A NIGHTMARE TO FIGURE OUT WHAT HER SHARE IN MY RETIREMENT IS WORTH AT THAT TIME. MY FUND CONSISTS OF A MENU OF MUTUAL FUNDS THAT I AM ABLE TO DIVEST MY MONIES INTO. WHAT SHOULD I DO.

I'm not a legal professional, but I did go through a divorce myself. My suggestion is that you get a statement or letter from your 401(k) provider that shows the balance of your account on the day you were divorced (or whatever effective date you used to separate your joint estate). File it away. If she ever does try to collect from you, then you have the proof to show what the 50% amount should be based on.
