Question about the Final Consent Forms ?????? Please Help.. IAAL !!!!!!


The final consent forms are from Georgia. CP and child in Ga. NCP currently living in Fl.

My hubby's court order papers state....

If either party to this action suspects that the other party is taking illegal drugs that party may request the other party to take a drug test within 24 hrs of the request. The party making the request will be solely responsible for the costs of such drug test. No party may refuse a request for a drug test.

My hubby ended up having to take BM to court to get his parental rights cause she decided that since they were never married she didn't have to let BD see their child. BD, under no court order had been paying $400.00 monthly in CS and had good medical and dental coverage on child for 5 years. BM of course had no problem accepting the check each month. BM had no dirt on my hubby except back 6 yrs ago, BM and BD smoked marijuana, together. Of course BM thought it would throw a wrench in things, but not enough, this is the only clause. So, now everything in the final forms and are pretty much understandable, except for this one.
We have just found out that BM's boyfriend put a restraining order(releif under family violence) on her. She lives under his roof and doesn't work, no car, nothing. He claims verbal and physically abused. He claims she destroys stuff in the house, chases him around the house with a knife, and has a pattern of continued substance abuse. Anyways,,,,
not the ideal up bringing for a 7 yr old to see. Georgia is all for the mothers. Even under these circumstances. SUCKS!!!!
What we would like to know is..
1. can hubby call a Dr's office in the town which she lives and explain the story. To see if he may set up appointment and pay by credit card?
2. can he request that the Dr's office send him the results without giving her the results first?
3. And, does anyone have any ideas that may help this father in this matter?
4. what else does he need to know or do?????

Neither party has used this stipulation before.
There has been several incidents in the household of the B/F. In which the BM(CP) lives with,as well as the child living there too. We are hoping that if he sets up the drug test and if it comes back positive, HOPEFULLY, A COURT WOULD DO THE RIGHT THING BY THIS CHILD.

Hubby still needs answers....


Please everyone, we are still looking for legal advice, but at this point, we'll take any opinions in this matter.

Please keep in mind that this is to help a 7 year old child.
Any info would be greatly appreciated.
