Quick Claim Deed + Loan


What is the name of your state? Oklahoma

My eldery mother in law owns her home, but has an outstanding loan on it, we need to get the house out of her name so that she can goto a nursing home. Can we do this without paying off the loan?

The forum members (at least the responsible ones) won't help you in defrauding creditors, Medicaid, or any other 'assistance' program.

If you need to get the house out of her name to reduce her assets so that she qualifies for government funding, have her sell the property.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Medicaid will not require that she give up or sell the home in which she lives, additional property yes, her residence, no. If she sells her home, the 'profit' above qualification limits must be spent on her healthcare. Any property that changes hand, or names, will disqualify your grandmother from receiving Medicaid benefits for 2 or 3 years.

Ellen, of course you are correct, but the 'telling' issue in my mind was "we need to get the house out of her name so that she can goto a nursing home".

Clearly the intent is for her NOT to live in the property and to do a 'shell' transaction on it.

And, please, it is a Quit-Claim Deed, not a Quick-Claim Deed! But it is sometimes done quick.
