Quit Claim Deed


How do I file a quit claim deed in Indiana. Husband and I are getting divorce. We agreed he gets the house. We are not using an attorney. Please advise.

If you want to do that yourself, you can go to the IU School of Law Indianapolis law library on the IUPUI campus and ask for a copy of one. The librarians there are very helpful.

I can do a quit-claim deed for you for $50. If you're interested, call my receptionist, leave all the pertinent info (addresses, names, phone numbers, etc.) with her. I can complete the deed, have you come in and read and sign it and you can pay me then.

FYI, something you might not be aware of: A quit-claim deed allows a party to relinquish his/her RIGHTS to the property but not his/her responsibilities if there is a mortgage and that person's name is on the mortgage.

That's because a quit-claim deed is an agreement between the two of you. The mortgage is an agreement between the two of you and the bank. Therefore, the bank is not a party to the quit-claim deed agreement and doesn't have to agree to take the person's name off the mortgage.
