really need help


north vernon, indiana. i wrote before to say our son filed chapter 13. well i was told we could stay in this home till our lease was up although the court told himhe had to try and sell this property since he owns it and rents to us. but now he is doing things. like he wants to take the decks off the front and back because he said his taxes are too high with them on. this is a mobile home. it sets way up and my husband and i are both disabled. if he takes the decks off it will have to be replaced with at lest 7 or 8 steps for us to get to the ground. plus the other kids built us a bridge from the front deck to get to the top where our car is parked. i am so frustrated with this. he said we could keep the bridge but the decks had to go. the bridge would then be way up in the air and of no use to us. is there any rights for us?? he bought this place and begged us to move here because he wanted us to be able to get out of an apartment. it had both decks when he bought it. what can we do??? please help us i am so tired of trying to figure this out on my own. thank you

My response:

For all intents and purposes, during your entire lease term, that property, including the decks, is your property. He has no right to disturb your enjoyment of the property as it exists, and in the form that you rented it. It doesn't matter that the taxes are higher with the decks. His taxes are his problem, not yours. You are entitled to the "quiet enjoyment" of your property during the lease.

Your only alternative is to call the police if he trespasses onto the property, for any reason. If you don't protect yourself, then say good-bye to the decks.
