restraining orders


What is the name of your state? ca can i get a restaining order against my exgirlfriends new boy friend that just threatened my life and my familys life. I don't want him around my son. he has a crimial record. my god i just broke up with her a week ago and found out about him. guess i 've been cheated on . I am so angry to think shes been seeing him behind my back. i have a police report. until i go to court, will that stop her from seeing him with my son around?

We can't tell you if you can get a restraining order. Go apply for one and find out.

Ummm...yes...I believe most court orders actually come from courts which, oddly enough, are located in court houses!

Go to the self help site of the CA Superior court, and go to the section for forms and print uot the forms for Civil Harassment CH-100 ... Fil them out either on line or print them and fil them out then take it to your county superior court, I already gave you the court locaitons on your other thread.

Also go to the FLF office at the same time then you can file for custody and visitation at the same time. You will need to do this before you can get a R/O to protect your child, you can get on to protect yourself though.

Scott, are you really afraid for your life, or just pi$$ed off?? Don't waste the courts time, or the police trying to get back at her because you are angry. Focus on your child and what you need to do to get things settled on that issue.

I will add that you are not the legal father of the child (and as such have no rights) until you have been adjudicated the father by the judge. Better get on this one.

I believe he has already signed the AOP, but I alrready told him what to do the other day and now he is considering having an out of state atty tell him how to fill out the forms and them represent himself, for $1800 when the FLF does the same for free, go figure.

He seems very young, very hurt, and very confused. I'm guessing 19ish...
