Question

Right Forum? Soc. Sec. Survivor's Benefits


What is the name of your state? Arkansas - sisters recently exed exboyfriend commits suicide, later she discovers she's pregnant by him. Hospital puts the father's name on birth certificate. child is now 5. would like to file for survivors benefits for child. grandparents do not have much to do with child. have heard that she can prove paternity through bloodwork involving grandparents. True? Does she have to prove paternity if father's name is on birth cert? how long would father had to have worked to be eligible? He was on disability - does that mean he was eligible for SSI? Have spoke with legal aid in our area and they are not much help.

The Social Security office has a pretty good website. There are lots of quetions and answers. Check out: [url]www.ssa.gov[/url]

You can always just call them and ask questions. I've heard they are hard to deal with, but my experience has not proven that to be true.

my father killed hisself when I was 5 and my mother did receive SS on me until I was 18. So yes you can file for SS on his child. Just contact the Social Security office and give them the information and start the process. Only got $25.00 a month but it did help. As long as his name is on birth cit. that is all they will need.
My cousin is raising her 2 grand children, both parents died and they both receive SS.

The problem is not in filing. the problem is that they were never married and Tony was not alive to "accept" the child as his own. That is why they tell us that we have to prove paternity. However, my problem with that is the fact that the child has his last name and Tony is on the birth cert as the father. Why should we have to prove paternity? The grandparents are not cooperative and the process will be expensive. Anyone that we have asked that question replies the same way "the hospital should not have allowed that" Well, the hospital did and can we not take advantage of that?

You know I agree if his name is on BC looks like it would be their problem to prove that the child is not his.
My cousin's daughter was not married to the man that was the father of her daughter. When they both died the child draws SS off the father.

TooSassy, I would file with the SS due to the fact that when you do prove and you can, they will owe you any back support for the child that will occur during the time that it takes to accuire the information that they will request.
