Right to visit mentally disabled parent?What is the name of your state? WV (where dad's nursing hom is), his poa is in KY, we live in SC My wife's father had a car accident when she was an infant and had a traumatic brain injury which has kept him in nursing homes. The paternal grandparents assumed custody of her father and barred the wife or his daughter (my wife) from seeing him after about age 10. Not legally barred but would threaten them w/ violence, etc so it was impossible. Of course they should have done something about it then, but this was in a very crooked small town and was 20 years ago so just dealing w/ the present state of affairs. My wife wants to reestablish contact with her Dad even though most of the time he doesn't remember her but her Dad's POA (his brother) and the paternal grandparents will not allow her to visit. Is this legal? Does the daughter have rights to see her dad? Even if they allowed supervised visits with her dad's family, we need un-supervised because they exhibit extraordinarily vicious & threatening behavior. We want her dad to meet his new granddaughter and could not take an infant around a potentially dangerous situation. Is this possible as well? It is his daughter, after all. thanks for the advice. |

| She would need to go to court and attempt it.
