Originally posted by kingdcart I have been living with a man for the past 6 1/2 years. I completely supported him for 2 1/2 of those years. We were living in a rented house. He bought a house for all of us and moved us all (my 2 children, him & I) to the house that he bought.
Now he has cheated on me and found someone else. He told me that we could live in the house till he sells it.
Do I have any legal recourse in this matter? The house is in his name only.
Are my children & I going to be put out without anything? Or do I have the right to something?
I just find it hard to believe that he could do this to us and I would end up with nothing, and be put out of the home we made together. |
My response:
At some point, during your relationship, the two of you must have discussed marriage and decided that it wasn't for you, believing that the Certificate "is just a piece of paper."
Well, now you've discovered it's anything but that. By consciously deciding not to marry, you left yourself without any rights or protections, and all you've been doing is "shacking up" with him. There are no protections without marriage, UNLESS you can prove there was a contract, whereby he promised in writing, or orally, that he would take care of you for the rest of your life. Proving such a contract is incredibly difficult and costly.
Ohio is a "Separate Property" State, and not a "Common Law" marriage State. Therefore, the house is his because it's in his name, alone, and there is no marriage without a Marriage Certificate.
