Question

seperated, preagnant


What is the name of your state? washington , I have been seperated from my husband for over 5 years though not a legal seperation he resides in another state. I have moved on and found a wonderful man and am now preagnant, now I have heard that no matter what my husband is the one who is considered the father is this correct?? if so how can i assure the new father has rights?

gee never thought of that lol divorce takes awhile especially dealing in another state couldnt possible be completed by the time the baby is due.

I agree, you should have divorced as soon as you separated or got a new bf! But you need to file for divorce now.

the real question


I appreciate the advise to get a divorce, yes that will happen eventually when i can find him, however in the mean time i would like to know if the new baby is considered my husbands, or if the father can claim his child.

Your husband would most likely be assumed to be the father. Your b/f would have to file for a paternity test.
