Service on military member?


What is the name of your state? Maine

How does one go about making proper service on members of the military in family law matters? I've read through the Soldier and Sailors Civil Relief Act of 1940 as well as the amendments of 1942 and 1991. It seems that members of the US Armed Forces (and allies ins om circumstances) are given broad relief from civil liabilities, enforcements of judgements...etc that are to be liberally construed. I know that if a military member voluntarily submits to being sued than there is no problem with service but what if they don't or if they can't be found. Do you have to go through the CO to serve a soldier-sailor or can it be done directly? Please help. Thanks for information

The best way to get in touch with the service member is through their CO or XO.

Yes, you can take that person to court over anything that you wish. The Armed Forces have what I call double justice. (1) By the Civil Court and (2) by the Military System (UCMJ) .You can go to the Company Commander and may get some results. Or for the BEST results (If you are in the right in the eyes of the law) have your attorney contact the JAG office of the branch of service that they are in. Give them all the info that you have. To include the Name; Rank: SSN of the person you wish to take to court.
I have over 40yrs with the Govt. most in uniform and still get upset when a service member try’s to get over on someone and use the Armed Forces as a shield.
You can locate the person by using their SSN. Good Luck to you.
