Something isn't right here. It is NEVER too late to determine parentage by DNA testing. The fact that you signed the birth certificate under that assumption that you were the parent has nothing to do with the actual determination.

Is it possible that you have asked for court funding to perform the tests and THAT was what caused the denial?? If so, you are certainly welcome to pay for testing yourself..... or have Montel do it.

"You can order DNA test kits online. There are some companies that offer kits that are acceptable by the courts."

WOW, great news!!! Now, the only question is how does this person get the other TWO people to agree to be swabbed when they refuse (it does take three, you know!).
DOH!!!

Yeah, I can see it now.

Judge: "Plaintiff, do you have the results of the DNA testing to prove that you are NOT the father of this child?"
Father: "Yes, your Honor. The test results show that I am NOT the father."
Mother: "Your Honor, there is no way that the test results presented can be accurate."
Judge: "Please explain."
Mother: "Simply, neither myself or my child gave a DNA sample to the Father to use for the test."
Judge: "Is that true?"
Father: "Well, kind of. I got the mothers sample from a coffee cup that was thrown into the trash, and I got the sample from the childs diaper".
Judge: "And what evidence can you present the court to PROVE that those base samples were in fact from this person and that child?"
Father: "None your Honor!!"
Judge: "Next Case"
Father: "DOH!!"

Besides, there isn't a court in this land that would accept the results of a test based on 'possible identification' of samples and done independent of a controlled environment!!!
DOH!!

Sorry, but the following is from the forum description:
"It provides general legal information to help people understand their legal rights in 125+ legal topics".

With all due respect, it is not a place for 'what if' and 'how abouts'. It is a forum for people to bring their legal questions and hopefully get factual, legal-based opinions and suggestions.

Truce accepted. Welcome to the forum.

By posting an off-topic question in the middle of someone elses thread, you divert the subject from theirs to yours. Which would be both unfair and rude to the original poster.

Please start a new thread for your off-topic post.

Actually, unless state laws dictate otherwise, mom is optional. We just used a buccal swab on the father (100% excluded) & son. Problem with DNA at home testing is that it's not court ordered of course & therefore is not generally considered by the judge (who may or may not order another lab test be run).

Nascarfan, please check the link below & find another attorney.
