sister troubles


What is the name of your state? new york , my sister resides in my home , has for 3 years , pays no rent . She has been causing me trouble and i want her gone , she refuses to leave , my lawyer states shes protected under squatters rights and i just cant throw her out .i am working on legal eviction but it is taking forever . If i throw her belongings to the curb and lock her out , what is my liability ? can she sue ?i'm desperate !

You can't just throw her belongings out and kick her to the curb. You need to start a lawful eviction. It can be time consuming but if you do the other she can sue you. If you don't own the dwelling then think about moving and getting your own place. If you are on title then my next question is she also on title? If she is you have another problem. CCP

Oh come on, she doesn't have her name on anything there, does she? You pay the bills, your name is on everything? Then kick her out! My brother has been staying with me for longer than he should've and I just told him he had to go, and that's that.

WRONG! If the sister (or in your case brother) leaves willingly - that's fine. But you cannot simply throw their belongings out and change the locks. The sister has become a tenant, and therefore the OP needs to follow the laws for eviction. Sorry, kel - but you're all wet on this one.

I probably should've used the more techincally correct "squatter" vs "tenant". But the OP got the right answer from his lawyer - he can't simply lock her out.
