I'm not sure if I am in the right place , but let's give it a try.
Last year my mother retired and registered to draw her S.S. benifits under my fathers benifit , my father passed away aprox 19 yrs ago so she was entilted to draw under his name.
After submiting her paperwork ,she was informed that in 1977 when my father was recieving disability benifits ,he was overpaid by aprox $12,000 , and they were of the oppinion that even though my mother had no knowledge of this overpayment , she is still responsible for repayment of this money.
Due to the fact that she was under a great deal of stress and the caseworker was doing a very good job of intimidating her , we agreed to their repayment terms of a minimal sum per month just to allow her to get on with her life and not fear finacial ruin .
The minimal sum was worked out so as to not place her in any finacial hardship , which is of real concern to her.
She aggreed in a written document provided and agreed upon by S.S. to the repayment , and was assured in the pressance of myself and my spouse that if she singed this particular doccument that it was a binding agreement on their part and would end any further action on their part forever in regards to this matter .
We even went so far as to ask if she were to win the lottery one week from then if they were going to return and start the entire process all over again .
We were assured by the case reviewer that she had the power to make the final decission and it was binding , Guess what , they now have decided that they want all of the money paid back within 13 months .
I do have a laywer on this as well as several senators , what can I do and is there any hope of this turning out in our favor.
This case is going on in michigan ... Thanks for any insight.

Contacting your Senators was one of the best moves you could make. It might take a few weeks to get a response because they forward your concerns to SS and have to wait for a response from them. Most government agencies jump pretty quickly when they receive Congressional inquiries.

Get the name of one staffer in each Senator's office and call them every week or two to inquire about progress. Good luck!
