some sister advice


What is the name of your state? KY

My sister has been living with the guy, well I guess I should say the man she was going to marry, and things have kinda gone south. He is wanting her to move out but she is needing some time to do this is. Can he legally throw her and her things out of the house, or lock her out of the house or does he have to have her evicted out of the house? The house is his home but they have been living in the house together for over a year now.

He would have to go through the process of evicting her. However, realistically its not going to be pleasant for her to continue to stay there if he wants her out, nor will it be easy to get her stuff back (she will get it back, but it won't be easy) if he locks her out.

Can your family help her get out and get situated?

She DOESN'T need to wait for a lease to run out, she doesn't need to wait to get her security deposit back - nmoving out shouldn't be that complicated? Is she sharing the housing costs there?

Does she have THAT much of her own stuff there that getting it out is a huge move?

She has all her belongings there. They have shared this home as their home. So therefore they both have all their things there. This move would not only involve her it would also involve her teenage son who have been living with them in the house also. So therefore it would take a little time to get them out of the house. There is not lease to run out. The house is his he is buying the home. At this time she has not been helping with the expenses because her son has been ill and had to under go some surgeries and therefore she has not been able to work. He has not been able to attend school or anything since August. He has had to be home schooled. He has been very ill. But before that she was helping with expenses and all. And until they moved into this house they was living in her apartment and he was living with her in this apartment and helping her with the expenses.

LdiJ gave you the legal and practical answer.

He isn’t supposed to “just kick her out.” There is a legal way to do this.

She shouldn’t stay because its unhealthy drama to say the least. It’s sad that she and her child are in this position but she needs to take measures to right this NOW and provide for herself and her child. Her family has more of reason to help her than the guy she moved in with.
