| | | | Son injured at school My son was injured at school. He was PUSHED off the slide by a second grader. He dislocated his arm and he broke his wrist on the other hand. He swears that the kid did push him, the kid looked right at him and pushed him. He suffered alot. It was terrible. I was stuck with the $5000 hospital bills, and he had to quit baseball. Can I be recompensated for the bills? The school said they weren't responsible. I live in Ohio. Is there a deadline on how long I have before I can do anything? |

| | | | I cannot speak about what would happen in your state, but in Indiana, parents can be liable for up to a certain amount of money for the deliberate actions of their children that cause damage to others.
Your state may have a similar provision.
Do you think the parents of the rotten kid have sufficient assets or income to pay a judgment? If they don't, then you'll be wasting your time, no matter how much merit your case might have.
If they DO, then go after them for reimbursement of your son's medical care, pain and suffering and costs of litigation.
Depending on the limitations in judgment amounts in parent liability cases and depending on the limitations in judgment amounts in small-claims court, you might be able to sue there.
Small-claims court is designed for folks who represent themselves, and it's for small amounts of money. Here the limit is $6 K, but if the state limits parent liability to $6K or less, you can use small-claims court as a speedier (and cheaper) mechanism to solve your problem.
I would suggest a consultation with an attorney in your state. Many offer free initial consultations.

| | | | child hurt at school Thanks for the info, but I have another question. When I contacted the school about who done this to my child, they would not give me information on who done it. So other than spying on the child after school, and seeing where he lives, and looking up their name and number and address up in the phone book and looking on their mailbox, what other alternative do I have for finding out these peoples infor. How do I find out if they own their own home and which insurance company they have? |
