spousal debts


what is the law (in Georgia) if your husband incurs debts that the wife knows nothing about. her name is not on the legal papers. am i liable for these debts simply because i am married to him. i make twice as much money as he does, and he has gone through all of his retirement and other resources. also i have a good bit of money in my retirement mutual funds. is he entitled to any of that ? that is solely in my name. i work two jobs to put money into that retirement fund. if we divorced would i have to give him half of my retirement mutual funds? our children are grown and i am tired of living like this. what is your advice?

My advice is to RUN to a local Family Law Attorney. If you do not, you could lose everything. Do NOT sit on this, go tomorrow!

If you have not yet made contribution to your fund for year 2000, hold off until you RUN to attorney. Some plans will let you make contribution up to April 2001 for year 2000 and even to Oct. if you file for extensions. Speak to your accountant or plan administrator right away before you put any more money at risk.
