    Spouse eviction

    What is the name of your state (only U.S. law)? Colorado

    Can I get my husband out of the house before filing for divorce without a restraining order?

    Actually yes she could. She could ask him to leave. he could consent. He could then leave. But legally if he doesn't want to leave and voluntarily leave, she needs a court order.

    Well I was just being complete in the answer. If he doesn't want to go however she needs a court order.

    Is there a REASON for a restraining order? Other than wanting him out?

    Oh, he can't force YOU out without a court order, either.
