Spouse took off with my truck


What is the name of your state? NC

We are separated and the truck is in my name, was bought before I got married to her as well as my house. She decided to take my truck and drive home to MD and has decided to not want to return my truck, she is ignoring phone calls and messages. I want to know what I have legal right to do in order to get my property back.

A: Go to Maryland with the title and registration, etc., get in the truck and drive it back home.

Title and Registration are in glove box of truck, but its all in my name..

so go to DMV,get a duplicate title and registration, go to maryland and get your truck.

have you reported it stolen?

You DON'T REALLY keep the title to the vehicle in the glove box, do you??

Do you suggest I report it stolen? Well I guess it technically is "stolen" And Yes I beleive I put the title in there, oops I just checked the safe and its not in there!

well, if you DO decide to report it stolen,

and then go to get it,

be sure to report it unstolen or YOU will be the one that gets stopped in it.

Ok police are telling me that since we are still married its community property... As far as i know since truck was prior to marriage its mine and NC doesnt fall under as a community property state. Someone help me out here I need my truck back, I am paying for it and can not even drive it!

Did you know that she took the truck in the first place?

Of course, the police may well be very wrong regarding the community property issue. However, I am sure that retrieval of the vehicle is your main issue at this time.

Do what senior said, go get the truck.

She didn't take the dog too did she??? j/k

Yes I know she took it and i know where she lives, she went back home to her mothers.
No she didnt take my dog in fact she didnt even take her cat!

cats make wonderful ride along buddies for road trips. Grab a truck, drop a kitty.

(Oh I can't wait for the blasting I will take for that one!! LOL)

well, he did say it was HER cat.. so why not reunite the kitty with its mom??
i am with you viruss, if NC is not a community property state, then how do the cop's know exactly what you can or can't do?? the truck was gotten before marriage, is in your name.. she has no basis to keep the thing.. these law's are so confusing anymore, that's why i chose to file in a state that doesn't really care why, how, you get divorced.. long as you do it legally.. lol
sure hope you go get that dang truck!! have learned in a short time, these people know what they're talking about..

Well just wanted to say thanks for the advice everyone. The truck is back in my possession, we took a little road trip and got there around 3 am and I jumped out of the car jumped in my truck and rolled off She threatned to report it stolen and I laughed since I couldnt possibly have stolen my own truck, its in my name Well anyway this case is closed Thanks all again
