What is the name of your state (only U.S. law)? Florida
My husband's aunt just recently got married. Her husband was getting SSI just recently Social Security stopped it. They told her that they have to count her income too but she is unemployed and she does not have any income but she owns 1/3 of her parents house which she owned before her marriage. She wants to know if they sign a postnuptial agreement now will he be able to get his SSI back? If so, does she have to hire an attorney to have it done or can she do it and get it notarized and does she have to file it with the court?What is the name of your state (only U.S. law)?

did husband update his records when he got married? or did he wait until they stopped his benefits before he said anything?

how was wife supporting herself prior?

a post-nuptial apreement won't do anything. a divorce might.

That doesn't make any sense if she has no income.

No, no type of agreement will work. Even if they were to divorce, he would have to prove that they do not live together before he can get his SSI back.

What the husband needs to do is to call the SSA and set an appointment to see a caseworker. He can then fully explain his situation and if he can provide proof that his wife has no income, and NO ASSETS, he can get his SSI back at least until wife is re-employed. Depending on the value of her asset, she might need to relinquish her ownership of her parents' home, because the SSA does consider the spouse's assets as well as thier income.
