Question

state health laws


What is the name of your state? oklahoma
if the county health department thought that someone you are related to had tuberculosis, but they didnt after testing and no one else you know has it can the health department make you take a tb test. also can they make me have my 9month old tested? if i dont have us tested they threatened to call dhs on me and have my child taken away from me. can they do that, even tho i have no chance of having tb?

If you are a possible health risk no only to your child but to the rest of the world, why not take the test? Even if you know it's negative....what is the harm?

a TB test is a simple tine test, they prick your arm, and if you have been exposed to TB, the area will swell. then you will need to have a chest Xray. to see if you have had it. (it leaves behind a "spot")

For some jobs it is a common part of the hiring process.

Just because you have been exposed does not mean anything bad, and if by chance you are "actively" infected you can get treatment so as not to suffer complications and most importantly spread the disease.

my aunt was exposed as a child (my grandfather had active TB in his 20's, -he lived to be 83 by the way...)but was never aware of it until she had to have the test as a new nursing student, no one else in the family ever tested positive. she was not active and this has had no affect on her life what so ever.

its the point.. they are treating the whole family like guinee pigs. they first told her she had cancer, then something else, now this. then they admit her culture of the abcess on (the outside) her lungs was mixed w/ someone elses and thats the only reason they started the whole tb thing.. since then the whole family was tested except me & my child, and i see no need for sticking any needle in my child unless I have to. I think i might wait and see what my sister in laws results that they sent back to the city come out as.. plus the hd hasnt contacted me personally yet and i gave them my name and number to call if i needed to take my daughter..

Hi Jackiefmok: TB is a "communicable disease" meaning there are guidelines that the CDC has established for healthcare personnel who test and/or treat those who have been exposed to TB or who have active TB. In institutional settings, such as prison, TB testing is required. As one poster suggested, it is also required at some places of work. Your family has, for whateve reason, been deemed "at risk". The test is very simple, and it be extremely important for you and your child (or anyone in your family) to be tested if there is reason to believe exposure has occurred.

If you do not allow healthcare personnel to treat your children for what they may have reason to believe is exposure to TB, yes -- you could be scrutinized by protective services. TB is a very serious health risk, and your failure and/or refusal to allow treatment could cause you some problems with DSS, not to mention the health problems you could face down the road.

I am an RN, and I have tested many for TB. In the setting I tested (a prison) those who refused testing were taken by force by security. Granted -- the health dept would not take you or your children by force for testing purposes, but this illustration may help you appreciate the seriousness of refusal of TB testing.

If exposure or active TB is confirmed after tests, medication is begun. If medication is begun, it is extremely important to comply.

Here is some pretty good reading on TB, guidelines for testing, etc. Some of it may be confusion, but I think you'll understand most of it.

I think everyone that has replied is taking this the wrong way.. I'm not refusing to take myself or my daughter...I just dont see any point in it when everyone that we are around on a daily basis has been tested and were negative. Trust me if even one of those test were positive we would have already gone. I don't believe there is any reason in it at all and then for them to threaten me with dhs is a crock. I do understand what the test is and what would be done if any of them were positive, but the people she and I are around the most come up negative, so there is no way we would test positive, or vice versa. But like I said, I'm not refusing to go if there is a need for it. Because if they don't have it then we dont have it. It's that simple. common sense. thanks for any replies.

common sense is: a $6 test verses DHS in your life for more than a year, I would take the test, sometimes principal is a waste of time... JMO...

and just because they are all negative doesn't mean you are or your child are... you could be the carrier and they have not been infected yet... look at it that way... not that they don’t have it and your not infected... its an easy test not worth the fight IMO…

And you would directly harm trying to protect your child over not wanting to have her arm pricked??

DRN, I find it almost spooky that you -- whoever you are -- would have searched hmmbrdzz to find out personal info and then make disparaging and untrue statements on a forum. Anyone who would do that is bizarre, has bizarre thinking, could qualify as a stalker, a criminal, and could be dangerous. This is the second time you've appeared behind my posts here making disparaging and untrue comments while using my real first name (that I didn't give you). Because I didn't give it to you or give you permission to use it, and because I don't know who you are, or where you live, or nothing about you, or what your capabilities are, it would appear I'm the one at a disadvantage.

I am a real RN with a real license, fully licensed with a real cert #, no restrictions, never been reprimanded, use this internet for one purpose -- to talk about my hobbies, my dogs, to read articles of interest regarding topics here, and to stay in touch with family and friends. what is going on here. It went from getting some advice to someone stealing something from someone else? please, whatever is between the two of you or three whatever, please take it somewhere else.. And for the book, I'm not jeapordizing my baby by not having her tested, since she is around the people who have already been tested negative everyday.. so it is quite impossible to have been exposed to it and not show up positive. They all would have been positive. Maybe you should read up on it again. Once exposed, any tb test you EVER take will be positive, even if you dont have an active case of tb at the time of testing.

Why are you being so unreasonable? If you have been threatened by CPS or some other organization, while I agree with you that I wouldn't like the threat, but is it really worth all this for a simple test? A test that could save your life and your child's life?

The CDC and the public has an interest to make sure this disease is not left unchecked. Your refusal to take this test puts all of our lives at risk. I don't want your refusal based on some kind of principle to put me at risk!

with all who said you and your baby should be tested. Taking a simple test should not be regarded as "infringing on your civil rights" either, especially if the agency enforces the issue. TB is a significant world health risk. End of story.

My response: If your child has a positive reaction (when tested), it is documented in the med record and subsequent testing is not performed because a positive reactor is always a positive reactor. That side of testing has nothing to do with what the health dept is -- according to your note -- recommending for your child (first time testing for some reason).

You've been given some good advice on this thread. You need to listen to the ones giving it, AND you need to especially listen to what the health dept is telling you. According to your note, the health dept might be getting ready to recommend that you ARE jeopardizing your child's health. Your continued refusal to cooperate might eventually become grounds for other authorities to step in.

There are certain diseases and other criteria that require mandatory TB testing. If you think it's worth your refusal to cooperate on account of some notion that testing and/or possible treatment is going to harm or hurt your baby, you really need to speak to the health officials involved in your case. TB is a communicable, contagious, and sometimes deadly disease.

No her future post will be DHS took my child how do I get the child back....

when will people learn you don't screw with DHS/CPS its like the IRS.. they do as they want....
