My brother who is 35 years old just recently had a child with a girl who just turned 18. The girl's mother filed charges against my brother nine months ago when the girl was still 17 at the time. The police did contact him and informed him that a prosecutor would be contacting him within the next thirty days. Well nine months has passed and he has not been contacted.
My first question is can my brother still be charged with statutory rape and because of the age difference how much time will he have to do? The girl mother has refused any money from my brother however, she has signed her daughter up for Gov assistance. Does my brother have any visitation rights? or even my parents? Unfortunely the mother and sister of the girl are refusing all contact . But what are my brother rights? If he has any?

| | | he needs to petition for a paternity test and visitation rights, even joint custody, and also he will have to pay child support. the state might end up taking care of much of the paperwork side of establishing paternity as the mom is going to be recieving aid. your family does not have rights to the child, but if dad's gets some visitation you can see the baby then. | |
