I have custody of my 16-year old daughter. Her father
(my ex) recently went to prison for the next 4 years.
She now is partitioning the courts to have her step
mom get custody of her. Her grounds for this is be-
cause she doesn't like the rules at my house. There is
no abuse or anything like that going on. Can this step
mom get custody of my daughter?

No.

My response:

I concur in the single word answer, above.

Also, I will conjecture at this point that your daughter and her step-mother are doing this on their own without an attorney. This, because, no sane attorney would accept a case like this in the absence of a real danger, or dangerous conditions, to the 16 year old.

Merely "not liking" the house rules is going to get the Petition thrown out of court, right along with the daughter and step-mother.

Imagine, if you will, the judge coming down off the bench, and grabbing the step-mother by the collar, and by the seat of her pants, counting "One, two, three", and throwing her right out the swinging courtroom doors.
