stepson is a molester


What is the name of your state? Missouri. My stepson is incarcerated in some sort of rehab in NC for molesting his 4 year old sister. He is 15 years old. I have a 6 year old daughter. Once his sentence is done, will he be able to go back to his mom and sister, or will he have to live somewhere else, like with his father, me and my young daughter? Do I have any recourse to protect my daughter?We live in a state 12 hours away. Thanks for any help.

If you are asking if there can be a forced change of custody (providing that your husband is currently the non custodial parent) the answer is NO (nor can visitation). Your husband can agree to take custody, at which point your choice would be to stay or to leave the house. His going back to live in the same home with the child would depend on the court orders and/or service plan the family has with social services. He could very well remain a ward of the state until emancipation. In order to obtain more information, your husband should request a copy of the files from social services & the court.
