| | | | my question is do i have any rights? do i have a case?
I live in Ohio, and here is the situation that my family
and i encountered.
My 3 yr, old daughter slipped and fell on the ice, on a friday night. she cried really bad and complained that her "bottom" hurt. She was behind me so i did'nt see how she fell. When she said her "bottom" hurt i assumed she meant her butt.
The next morning when she went to the bathroom, she cried that it hurt when she peed. I went in to the bathroom and she had blood in her panties. and some blood when i wiped her. I figured that she had tore herself when she fell, but was also concerned that maybe she could of brusied a kidney,
or hurt something else. I called the pediatrician that
morning (Saturday) and made an appointment to take her in that day. The Dr. my children normally see was not in, so
she had to see the nurse practicioner. she immediatly said
let me go get the Dr. that was in that day. She immediatly
told me to go to Childrens Hospital, and have them check this out. She said she would call ahead and let them know
that we would be comming in.She said that we needed to let them know that she was the Dr. who sent us and that she would appreciate a call as to what they found.or she would call to get the information. I knew when i left there, what
was in the back of there minds. (sexual abuse) I took her to Children's Hospital. There they had several Dr's, and nurses come in and speak with her, and check out her vaginal
area. Then they had a social worker speak with my husband and i, and then with our daughter. She spoke to her asked her questions, and had her draw some pictures for her.
Then she and the Dr. came in and said that they were sorry, that we had to go through all that , but it was standard proceeder, with an injury of that type. and that they had to
let children's services know that we were in, but there
would be no abuse report made. They said they had no reason to suspect that anything else had happened besides what we
and our daughter had relayed to them. They did say that
it was up to us, but if we wanted to pursue the injury any further, we could take her to a specialist on monday. She said it was up to us, and that they would not be making any referal. When we left there, and got home, my husband, mother and i decided not to pursue it any further that she had been through enough. She kept questioning as to why they were asking her those questions, did they want to take her away. did she have to show her bottom to anyone else, etc... and was insistent that she sleep with us, I cant even go out of the room without her freaking out.
I let her know that she would'nt have to do that anymore,
and everyone just wanted to make sure she was O.K.
Well that Tuesday i was taking a shower getting ready to take my oldest daughter to the orthodontist, When i hear someone banging on my door. I go to the door and this
ladies like Hello my name is so and so from Children's services, and i need to speak to you, i Was like what?
From what i understood it was done and over with. Thats what Children's Hospital told me, and she said well its not. She questioned me, as to why i did'nt take her and have her scoped on monday. i said i was lead to believe that i did'nt have to, it was entirly uo to us.
Then she questioned my 3yr. old ( who's 4 today)
again. and then questioned me as im still soaking wet, with a towel on my head. and then said she would be back the next day, to question all the children in our home. (we have 3 others (1,11,and 13)and my husband. I said well i have to tell you, that i am quite surprised, that Children's Hospital would contact you. She did'nt say anything.
The next morning i got a phone call from children's Hospital.( Where they do the check that magnifys her
vagina to make sure no more damage is done) She said that in
light of childrens services getting called, about this she would highly suggest that we bring her back in for this
test. I said that i absolutly would if this is what it would take to put everyones fears to rest. Then I said to her, i was under the understanding when we left children's
hospital, that that was it and no report was going to made, what happened between then and now to make someone change there mind? she said we did'nt, your pediatrcian that sent you here made the report. I said Why she said we dont know,
we did'nt talk to her i said What? then why would she make
this call? They said they had no idea. So I called the Dr.,
that i normally take her to see, he runs the practice, explained the situation. He called me back and said yes
Children's Hospital did confirm the informaation that you gave and yes they confirmed that she was the one who called Children's Hospital. He said i dont know why she would send
you to Children's hospital, and call Children's services before getting a report from the hospital.I have no answers
for you. But i will look into it. So I took her up let them do the thing where they magnify, and the Dr. said everything looks great,i dont see anything that would indicate sexual abuse, i'll call and let Childrens service know. The lady from Children's Services came out and i told that i was not happy with the situation that all this could be avoided had the Dr. got the report from the hospital.
She said she was satisfied that everything was Kosher, have ever she went ahead and continued to question my other children, and then me and my husband then said she was
satisfied and would close the case.
I had to sit down and explain the whole situation with my children, who were then in return extremly worried. my 11 year old did'nt want to go to school, because she was afraid that they would come take the 3 yr. old away.
There was absolutly no reason, that my family had to go through all that, if that Dr, would have followed through the way she should've. Not to mention they made a police report, and the lady from social service did say that she cancelled it however we live in a small town, that my husband has lived in for 20 yrs. and he was like great thats what i need is for this to get out, how embarassing would that be?
Do we have any rights? Do we have a case?

Please help! | Unfortunately Dr's, teachers and other child care specialist or people that work with and care for children are immune from civil liability when making referals to CPS. Unless it can be proven they did so out of vengeance.
I would suggest you go to this link though and look into the matter further and maybe they can give you more info.
