Suing one's spouse

What is the name of your state? New York

My friend is 73 years old and has been married 40 years. She is the owner of her home but the tittle is under both names.
3 years ago the house finally got paid of and her husband went ahead and took another mortgage on the property without her knowledge. He used the proceeds of the mortgage to purchase a house for his daughter from a previous marriage.
What are my friends rights?
What course of action should she follow
Can she sue her own spouse under NY state law
