Question

surviving Spouses Rights


What is the name of your state? Oklahoma
My sisters husband just passed away, and supposedly his 3 grown kids have a will they he had made before he and my sister got married giving the house, cars and other itmes to them including the life insurance and his retirement savings account.
However, since then he and my sister have been married over 5years lived together over 10yrs shared the same checking & savings account over 10yrs and they both sold there houses bought one together, sold the cars that wer listed in this will. He became terminal with cancer the last year and half and my sister had to take care of him. When he retired he had to redo all of his insurance and savings information reassigning beneficaries, my sister never signed anything waiver her rights to antything. What rights does she have? will she loose her home and everything?
They want all of his clothes, his false teeth, everything that was his.
Please help!

Try posting this on the "wills and probate" forum. YOu should get a lot of help there.

I don't know the specifics, but I do know the surviving spouse has quite a few rights and is entitled to a share of "community" property between the two.

The children cannot take anything that has her name on it such as car, joint checking account, insurance, IRA, etc.

The estate account needs to be set up. She does not have to let them take anything or even enter her house.
