Tenancy in Common vs. Joint TenancyWhat is the name of your state? CA My boyfriend and I own a home. Assume the title is Tenancy In Common and he should die. His interest in the home passes on to his heir, minor son. When would his son be able to collect on the estate? Would I have to immediately pay his son's guardian (his ex-wife) the full balance of his father's estate, or there a law that limits the guardian from selling the house? Would a Will or Trust limit the ex-wife from collecting? |
