What is the name of your state (only U.S. law)? Floria
How can a custodial parent have the Non-custodial parents rights terminated? Is this possible, can Non- custodial parent just sign a document in court to terminate there rights of the kids? They have been paying child support for two years, havent seen the oldest child in three years and has never seen the new born baby since it was born.

Yep, this question has been answered about 1,627,986,413 times! BUT, just in case OP doesnt know how to navigate a system (meaning ours hehe) and to prevent further posts from OP...I'm going to answer it for the 1,627,986,414th time :D

OP, NO you cannot just have NCP rights terminated UNLESS you are legally married for a year or more (some judges will allow an adoption with less though) and have a husband/wife who is willing to adopt the child. ALSO, NCP has to legally consent to the adoption as well as attend both a hearing and counseling session to determine that he/she is well aware of the decision they are making in terminating. Here in FL, judges arent in the habit of basterdizing children just because mom/dad decided they no longer like the other parent. :rolleyes:

You can read the state laws regarding termination of parental rights in chapter 39 of the statutes at: Statutes & Constitution :View Statutes : flsenate.gov
