| You should post this in the criminal section but I might be able to help a bit... however i could be wrong. I'm in a similar situation nowand I'm also in Indiana. My brother-in-law is in jail and the best witnesses the prosecution has is his parents and his brothers. The story I've gotten is the only person allowed to get out of testifing is a spouse. Even his parents are not immune to this if they are chosen to testify. Is the father still in jail? How does the son feel about his father. You may be able to stop visitation if the crime is of significate manner to a, protect your son and to b, prevent the father from playing mind games on him. As far as you being in there during the deposition I doubt you can but I may be wrong.
