Question

Troubled Marriage


What is the name of your state? PA

My SIL in Pennsylvania has been in a horrible marriage for 7-8 yrs. They have 2 children 3and 6 yr old. She has been mentally tortured to no end, and finally wants out. She is very easily intimitated and does not have a strong personality to take action on her own.

She wants to move to Oklahoma with her brother who will help her sort this mees out. She has a very supportive family.

Ok, the question is, if she does move, could that land her in any sort of legal problem? That is, could her husband accuse her of kidnaping the kids? Or any other issue that could jeopardize the custody issue when it does get to that point.

Her husband can immediately file in his state to have the children returned to that court's jurisdiction and for divorce and custody and sole possession of the marital home. Most courts will grant that and then she will be stuck without her children while dad has them which CAN impact custody later.

Parents should remember two things: Love your kids more than you hate your ex (or soon to be ex) and when you have children the relationship with the other parent is until death parts you.
