Unauthorized separation of child from parent


What is the name of your state? california

like any other married couple when money is tight we have arguements, but i never verbally or physically abuse my wife or child. however, my wife is wanting me to find a higher paying job and is planning to take my child with her the los angeles against my will and against his will (he is 5 years old) and stay there until i have that new job. can she legally do this without first trying to file some sort of complaint, domestic violence suit or divorce suit? isn't there a law to protect my child's and my rights against her taking him without proper procedures? what can i do legally to prevent her from taking this action, or if she takes the action then what would be my options of returning our child back home?

Since you are married, both of you have equal rights. One option for you is to immediately file for divorce, custody and child support, and find out about retaining the home and her moving.

Otherwise, she can do what she wants, and once she's there, she can file for divorce, custody and support. Your marriage sounds like it's in trouble to me.
