| | | | in most states a child can choose where he/she wants to live after the age of 12. it sounds like it would be a good idea to contact an attorney in the county your nephew lives in and see if there are any that can help. |

A judge ‘may’ or ‘may not’ decide to listen to the child in the first place. Then the judge will decide during private questioning of the child, whether they are mature enough to understand the situation and the consequences of their decision.
