Unmarried, unhappy, can I leave the house with my child?

What is the name of your state? CA
I have been unhappy with my partner for two years. We have a two year old daughter and live with my parents. I am done trying to repair relationship. He mentally and emotionally threatens me with taking my child away from me if I separate from him. My parents do not support me so I need to move out. Can I take my child with me until court proceedings? without being accused of kidnapping or something like that?
